GENERAL TERMS & CONDITIONS

Terms & Conditions may be updated or revised without notice at the discretion of Wingback Travel.

The terms “Wingback Travel,” “Wingback,” “we” and “our” in this document refer to Wingback Travel LLC and its related and affiliated companies, including their employees, guides, and contractors. Wingback Travel is a Connecticut Limited Liability corporation. All trips are offered subject to Wingback Travel’s standard terms and conditions to tour-specific terms and conditions, which are found on your issued statement of account and by request. Please review the terms and conditions carefully prior to completing your reservation. Should you have any questions or concerns please contact Laura (laura@wingbacktravel.com).

PRICES, RESERVATIONS AND PAYMENT

To reserve your Small Group Scheduled Wingback Travel trip, we require a $1,500-$2,500 deposit per person (see tour-specific terms for payment amount). The balance of your payment is due 90 days prior to departure. If reserving your trip within 90 days of departure, full payment is required. To complete your reservation, you must sign an Acknowledgement of Risk, Release and Indemnity, prior to your date of travel with us. These will be sent to you in your booking confirmation email.

CANCELLATION POLICY

Wingback Travel has financial obligations to our partners and all payments are non-refundable, except in the even that you have someone to take your place at the time of your cancellation. We strongly recommend that you purchase travel insurance and are happy to recommend several options.

ELIGIBILITY

We require that travelers be at least 18 years of age at time of travel on all Small Group trips. Any trip entails risks—and rewards—beyond those encountered at home. We count on our travelers to read our pre-trip materials about clothing and etiquette; and to appreciate that in some countries local living standards, practices, services, and accommodations may differ from those to which you are accustomed. Our trips are not especially strenuous but do require moderate physical output: our walking tours and museum visits are 1-2 hours long and our tours average 10,000-15,000 steps a day, over uneven pavement and/or stairs. Visits to antique markets can last between two and six hours, depending on the size of the market. 

TRAVEL DOCUMENTS

Travel documents, which may include, but are not limited to, visas, passports, proof of vaccination, proof of COVID-19 testing, proof of medical insurance, and any other government-mandated documentation required by countries to which we travel may vary according to the nationality of each traveler and may change at any time for reasons beyond our control. Although we endeavor to provide you with accurate information about these requirements it remains your responsibility to verify that you have the appropriate travel documents related to this trip for your nationality. Wingback Travel is not liable for any expenses or costs arising from any traveler being prohibited from entering a country scheduled to be visited on a trip.

EXTERNAL TRAVEL SERVICES

Wingback Travel may recommend the services of external travel companies or other support services in response to requests made by travelers for services outside of the scope of a Wingback Travel trip. Although we endeavor to recommend only companies that provide the highest levels of service, we do not guarantee the services provided by third parties. Wingback Travel is not liable for any injury, expenses, costs or cancellation penalties arising from any services, or lack thereof, provided by any third party nor the standards of care which travelers experience when using those services.

HEALTH & COVID-19 POLICY

As a condition of participating on a Wingback Trip, each traveler must be fully compliant according to the requirements of the country(ies) of destination at the time of travel. Each traveler shall also be responsible for carrying and providing to local authorities and service providers such proof of vaccination, proof of COVID-19 testing, proof of medical insurance and all other government-mandated forms required by local authorities in the country(ies) of destination. Though we endeavor to provide you with as much current information before your departure, it is ultimately your responsibility to be aware of and to comply with all such requirements and laws. Should measures such as masking, testing, or showing proof of vaccination be required at the time of travel by the country in which your tour is visiting you will be expected to comply with said requirements. Should you decide to cancel your trip because of any of the just-mentioned health measures, any refund would be subject to our cancellation policy.

RISKS

Wingback Travel goes to great lengths to ensure you have a comfortable trip. There may be facilities, infrastructure, safety and other standards that may not be sophisticated and may be different from those in a traveler’s home country. Trips involve physical activity that can be demanding, depending on the condition of the traveler, and the risk of serious personal injury, including permanent disability and death from accident, illness or the actions or negligence of other persons.

Risks related to travel also include the likely presence of the virus that causes COVID-19, including variants (collectively “COVID-19”). Rates of COVID-19 infection may be higher, and rates of vaccination may be lower at the locations of your Trip than in your home state or country, and that the sophistication and availability of therapies, medical practitioners and hospital beds for treatment of COVID-19 may be significantly impaired. Laws, regulations, customs and policies related to COVID-19 in the destinations and premises where you will travel on Trip (“Local Regulations”) may be different than in your home country. There are other risks associated with the trips, such as theft or loss of or damage to property. Some of the services provided in connection with the trip, including lodging, transportation, food service, and local tours and activities, are obtained from independent suppliers over whom Wingback Travel has no control. 

IF WINGBACK TRAVEL DEEMS NECESSARY TO CANCEL A TRIP

Wingback Travel reserves the right to cancel any scheduled trip at any time for any reason determined in our sole discretion. We have also introduced a special cancellation policy specifically related to COVID-19 described below.  

All group tours must have at least five participants: In the case that a tour does not meet its minimum capacity of five participants 90 days prior to tour start date, Wingback Travel reserves the right to cancel the trip. In such cases, travelers will be refunded the full amount of monies paid.

Force Majeure Excluding COVID-19: In the event Wingback Travel determines to cancel a scheduled trip for reasons of force majeure (subject to the COVID-19 policy described below, but including acts of war, terrorism, civil unrest, quarantine, curfew, natural disaster, pandemic, epidemic and other causes outside of Wingback Travel’s control), or if the quality of the trip or the safety of the travelers is judged by Wingback Travel to be compromised by factors external to Wingback Travel. In such a case, Wingback Travel will endeavor to refund payments received by Wingback Travel. We ask that our clients recognize that there are expenses, including unrecoverable third-party deposits, that Wingback Travel cannot recoup as the planned date of a trip approaches and as a result, a full refund is not always possible. However, we will make every effort to recover, for the benefit of our travelers, as many of those expenses as we are able.

COVID-19 and Other Reasons for Cancellation: In the event Wingback Travel determines to cancel a scheduled trip due to restrictions imposed owing to the global pandemic caused by the COVID-19 virus or its variants, or for internal reasons within the control of Wingback Travel, unless otherwise provided in the affected travelers’ Statement of Account, payments received from travelers for the cancelled trip will be returned to affected travelers in accordance with the following:

· 91+ days prior to departure: 100% of deposit

· 0-90 days prior to departure: 100% of your deposit plus any costs we are able to recover from the final payment you made 90 days prior to departure

Requirements for travel and public can change frequently and with very little notice. Should public health officials in any country we are visiting institute masking or testing requirements, or require you to show proof of vaccination, you will be expected to comply with these rules. Should you decide to cancel your trip because of a masking or testing requirement, or a requirement to show proof of vaccination, you will be subject to our cancellation policy in the above section (See CANCELLTION POLICY). 

WINGBACK TRAVEL’S DISCRETION TO RUN SMALL GROUP SCHEDULED DEPARTURES

Wingback Travel retains the sole discretion to run any scheduled trip notwithstanding the occurrence of any event or the existence of any condition in or near any place of travel included on a trip itinerary or in proximity to such a place or affecting travel, including air travel, in general. If Wingback Travel determines in good faith to run a trip, then with respect to that trip, any traveler cancelling a reservation shall be bound by the cancellation policies applicable to trips cancelled by the traveler in accordance with the provisions above.

RESPONSIBILITY AND INDEMNITY AGREEMENT:

Wingback Travel of Wilton, CT and your tour escorts act only in the capacity of agents for you the participant in all matters pertaining to hotel accommodations, sightseeing excursions, all means of transportation and all other features of the tour, and as such, are free of responsibility for any damages from any cause whatsoever. Wingback Travel will not be held responsible for any damage, expense or inconvenience caused by late arrivals/departures or by any other schedule changes and or other adverse conditions. Nor will Wingback Travel be held responsible for the loss of or damage of baggage or any other article belonging to the tour participant. No refunds will be made for absences from any portion of the land tour. The right is reserved to decline, accept or remand any person as a member of this group at any time before or during the tour. If you must make an insurance claim, you must contact the insurance company directly with your insurance confirmation number.

The right is reserved by Wingback Travel to make alterations or substitutions in the provided program should local conditions or transportation schedules so require. Land rates are based upon those in effect at the time of the tour announcement and are subject to change without notice if currency exchange rates should fluctuate drastically. If any changes in price are made the tour participants will be notified immediately.
